Cases Accomplishments: Medical Malpractice: Involved failure to recognize and diagnose a very serious infection which became systemic and resulted in the loss of both legs in a 50 y/o man with preexisting medical problems with poor circulation. Resulted in over $1 million settlement in 2000. Personal Injury: Involved a client who was struck by a county sheriff's patrol car resulting in a TBI, left hemi paresis, severe dysarthria, and multiple fractures. Defense alleged client was at fault, and was not wearing a seat belt. Dr. Thomson was responsible for identifying, locating, and preparing the medical damage witnesses (treating physicians, PT, OT, Speech therapists, etc). She prepared all the medical records for those testifying and entered them as trial exhibits. She wrote and suggested questions for each witness for the attorney. Jury verdict was $30.5 million, including no comparative negligence on the client's part in 2005. Personal Injury: Involved a client with five MVA's, and ten years of medical records. Dr. Thomson made a chart of each accident to help identify the injuries and causation of each accident. She met with each of the treating physicians and assisted them in providing narrative reports to the attorney addressing their treatment, causation, and prediction for future medical expenses. She prepared all the medical damage witnesses for depositions and presented a live summary of injuries to a panel of three judge arbitrators. The case settled for over $4 million in 2004. Nursing Home Negligence: Involved multiple clients with various failures to diagnose and treat a head injury from multiple falls, infections leading to amputation, and an infected total knee leading to a fusion. Dr. Thomson assisted the attorney who had her prepare all the trial exhibits, interview the treating physicians, and teach the medicine regarding the negligence. She participated in the mediations by presenting a live summary to the attorneys and mediators, using her exhibits. Each case settled for more than $750,000 in 2002-2005. Toxic Tort: Involves an ongoing litigation that Dr. Thomson has participated in since 2001 alleging damage from exposure to PVC gases. She has served as the physician liaison between the attorneys, experts and clients. Initially Dr. Thomson developed a master chart containing all clients and their symptoms and has produced the medical chronologies, assisted with answers to interrogatories, carried out literature searches, visited treating physicians before their depositions, met with all 28 clients, helped prepare attorneys for defense experts depositions, chaired a meeting with all attorneys and experts to initiate better communication, obtained medical records, developed a questionnaire for all clients to fill out regarding work place issues, and she continues to function as part of the plaintiff legal team. Dr. Thomson did testify for nine hours regarding an issue the defense brought up for a Summary Judgment. She was the only one who had the continuity of the case facts. Following her videotaped testimony (2004), the Summary Judgment was dismissed. Settlements from some of the defendants have occurred and are ongoing (2005). Products Liability: Involves a female who was rear-ended by a Mack truck and her car safety system failed. She was a T7 paraplegic. Dr. Thomson assisted the attorney with management of treating physicians and out of town experts as well as identified the medical testifying witnesses who were most effective, and prepared them for trial. She prepared medical records for witnesses, exhibits and the attorney and made suggested questions for the attorney to pose (with answers)! Dr. Thomson coordinated and chose medical exhibits and met with the medical illustrator dozens of times. She attended the trial and assisted in discrediting defense experts leading to a jury verdict over $20 million in 2001. |
